Terms of Service

1. Who we are
Aethiq is a software-as-a-service quoting and proposal platform for solar and battery installers, operated by Claudio Conca, trading as Aethiq ("Aethiq", "we", "us"). By creating an account or using the service, you ("Customer") agree to these Terms.
2. What Aethiq is — and is not
Aethiq is a business productivity tool. It helps you generate quotes, bills of materials, and client proposals. It is not:
• A licensed financial adviser or investment adviser
• A registered engineer or accredited system designer
• A guarantor of system performance, government rebate eligibility, or grid connection approval
All sizing recommendations, STC estimates, incentive information, and regulatory guidance provided by Aethiq are indicative only. You are solely responsible for verifying all figures, regulatory requirements, and technical specifications before presenting them to clients or entering into contracts.
3. STC and incentive estimates
Small-scale Technology Certificate (STC) values shown in Aethiq are estimates based on current spot prices and publicly available data. STC values fluctuate daily and are subject to change based on installation date, system size, deeming period, and market conditions. You must verify the current STC value at cer.gov.au before finalising any quote. Aethiq accepts no liability for differences between estimated and actual STC values.
4. Grid connection guidance (South Africa)
SSEG grid connection pathways, distributor requirements, compliance checklists, and timeline estimates shown in Aethiq are indicative only and based on publicly available information. Requirements vary significantly between municipalities and change without notice. You must verify current requirements directly with the relevant distributor before committing to a project timeline or quoting connection costs to clients.
5. Your account and responsibilities
You are responsible for:
• Maintaining the security of your login credentials
• All activity that occurs under your account
• Ensuring your use of Aethiq complies with applicable laws in your jurisdiction
• The accuracy of client data, product pricing, and system designs you enter
• Independently verifying any AI-generated output before relying on it
You must not use Aethiq to store or process data that you do not have the right to use, or for any unlawful purpose.
6. Subscription, billing and cancellation
Aethiq is offered on a subscription basis. Your plan, pricing, and billing cycle are shown in your account settings. Subscriptions renew automatically unless cancelled before the renewal date. You may cancel at any time through your account settings. No refunds are provided for partial billing periods. Free trial periods convert automatically to paid subscriptions at the end of the trial unless cancelled.
7. Data and privacy
We process your data to deliver the Aethiq service. Our Privacy Policy, available at aethiq.app/privacy, forms part of these Terms and describes how we collect, use, store, and delete your data. You retain ownership of all data you upload to Aethiq. We do not sell your data or use it for any purpose other than delivering the service.
8. Intellectual property
Aethiq and its underlying software, design, and content are owned by Claudio Conca trading as Aethiq. We grant you a limited, non-exclusive, non-transferable licence to use the service for your business purposes during your subscription. You may not copy, reverse-engineer, resell, or sublicence the software.
9. Limitation of liability
To the maximum extent permitted by law, Aethiq's total liability to you for any claim arising from or related to these Terms or the service — whether in contract, tort, or otherwise — is limited to the fees you paid to Aethiq in the 12 months preceding the claim.
Aethiq is not liable for:
• Loss of profit, revenue, or business
• Loss of data beyond what can be recovered from our backups
• Indirect, consequential, or punitive damages
• Any loss arising from reliance on AI-generated output, STC estimates, or regulatory guidance without independent verification
• Any claim by your clients arising from quotes or proposals you generated using Aethiq
Nothing in these Terms limits liability that cannot be excluded by law, including under the Australian Consumer Law or applicable South African legislation.
10. Service availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may suspend the service for maintenance, upgrades, or circumstances beyond our control. We will provide reasonable notice of planned downtime where possible.
11. Termination
Either party may terminate these Terms at any time. We may suspend or terminate your account immediately if you breach these Terms, fail to pay fees when due, or engage in conduct that puts other users or the service at risk. On termination, we will provide a data export and delete your data within 30 days, retaining only minimal billing records as required by law.
12. Changes to these Terms
We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of New South Wales, Australia. Any dispute will be subject to the non-exclusive jurisdiction of the courts of New South Wales.
